Data Processing Agreement

1. Parties

This Data Processing Agreement (“Agreement”) is made between Targetin' Group, accessible from www.targetin.io (“Data Controller”), and the User (“Data Processor”), collectively referred to as the “Parties”.

2. Scope and Purpose

This Agreement sets out the terms and conditions under which the Data Processor will process personal data on behalf of the Data Controller. This processing is to be carried out in relation to the services offered on www.targetin.io and as described in the Privacy Policy.

3. Compliance with Laws

Both Parties will comply with all applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR).

4. Data Processing Terms

• The Data Processor agrees to process personal data only as instructed by the Data Controller and only for the purposes outlined in this Agreement.

• The Data Processor shall ensure that all data processing is performed securely and in accordance with the best industry practices.

• The Data Processor shall assist the Data Controller in providing subject access and allowing data subjects to exercise their rights under the GDPR.

 

5. Data Transfer

The Data Processor shall not transfer personal data to a third country or an international organization without the prior written consent of the Data Controller.

6. Data Security

The Data Processor agrees to implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including, as appropriate, the measures referred to in Article 32 of the GDPR.

7. Breach Notification

In the event of a personal data breach, the Data Processor shall notify the Data Controller without undue delay and, where feasible, not later than 72 hours after having become aware of it.

8. Termination

The Data Processor’s duty to process personal data shall end upon the termination of their use of the services at www.targetin.io.

9. Audit Rights

The Data Processor shall make available to the Data Controller all information necessary to demonstrate compliance with the obligations laid down in this Agreement and allow for and contribute to audits, including inspections, conducted by the Data Controller or another auditor mandated by the Data Controller.

10. Governing Law

This Agreement shall be governed by the law of EU, without regard to its conflict of law principles.
